Legislative Updates

  • SB22-210 - License Supplemental Health-care Staffing Agencies – Emails and letters are being sent out and reporting is now open. https://socgov11-comm.force.com/LSCS/s/login/SelfRegister. The reporting period begins April 1, 2023 and ends on April 30, 2023.
  • FAMLI Premiums must be paid no later than the last day of the month immediately following the end of the calendar quarter for which the premiums have accrued. While the first payment is due April 30, 2023, the Division is offering a 30-day grace period before the first payment is considered late in order to give employers plenty of time to get comfortable using the system. https://famli.force.com/
  • Colorado Secure Savings Plan - All Colorado Employers who qualify, are required to participate unless you have your own plan and qualify or an exemption.

o    If your business has 15-49 employees, your registration deadline is: May 15, 2023

o    If your business has 5-14 employees, your registration deadline is: June 30, 2023

o    Employers with 50 or more employees, Your deadline has passed. Take action today. Register your business now

  • HB23-1030 Prohibit Direct-hire Fee Health-care Staff Agency – Passed in both houses, with no amendments, but we were able to get a 30 day TTH conversion period (asked for 120),  instead of the proposed one day conversion period. It has not passed yet on the conference committee as there are errors and questions on how it was amended and how it applies to foreign workers. Direct Hire contracts won’t be affected, just conversion periods. May have to start changing invoices, raising rates to recoup costs in order to do that. Start negotiations with clients now.
  • Bills to watch:
  • SB 105 - Equal Pay for Equal Work – LAST ACTION: 04/6/2023 | Senate Committee on Appropriations Refer Amended to Senate Committee of the Whole
  • SB 058 - Job Application Fairness Act – LAST ACTION: 04/5/2023 | House Committee on Business Affairs & Labor Refer Amended to Appropriations. Starting July 1, 2024, the bill prohibits employers from inquiring about a prospective employee's age, date of birth, and dates of attendance at or date of graduation from an educational institution on an employment application.
  • HB 1078 - Unemployment Compensation Dependent Allowance – Still monitoring but will probably die on the floor.
  • HB1076 - Workers' Compensation Bill – Paying dollar amount instead of percentage, which is bad for companies that place high risk jobs. Having a group call with Pinnacol would be a good idea.
  • SB 017 - Additional Uses for Sick Leave – Polis has issues with this bill  but it hasn’t been rejected or passed yet.
  • HB 172 -  "Protecting Opportunities and Workers' Rights (POWR) Act"– Harassment– coming out of committee and might pass, but it has many issues and many are asking for a compromise. https://tsscolorado.com/harassment-bill-passes-first-test-with-changes-and-questions/
