2025 Legislative Watch: Key Bills to Track

HB 25-1001 – Wage Theft & Worker Misclassification Enforcement

  • Expands liability to business owners (25%+ ownership)
  • Raises wage claim limit to $13,000
  • Increases fines up to $50,000 for willful misclassification
  • Creates a public “bad actor” list

Impact:
Agencies must ensure W-2 vs 1099 classifications are legally sound. Owners could now be personally liable. This bill is expected to pass with support.


SB 25-083 – Healthcare Non-Compete Limitations

  • Bans non-competes and non-solicits for physicians, APRNs, and dentists—even if they’re highly compensated
  • Allows reasonable bonus/relocation repayment agreements (prorated, max 3 years)

Impact:
Agencies placing healthcare professionals will need to revise contracts if passed. Positive news: repayment clauses are still allowed with proper formatting.


HB 25-1264 – Ban on Surveillance-Based Pay Decisions

  • Prohibits use of behavioral or biometric data to set wages
  • Targets AI that adjusts individual compensation based on tracked data

Impact:
While uncommon in staffing, agencies using performance-tracking tools (keystrokes, mouse activity, webcam, etc.) must avoid linking that data to wages.


SB 25-005 – Union “Second Vote” Repeal

  • Would eliminate Colorado’s requirement for a second vote to authorize union dues/fees after certification

Impact:
Could increase union organizing activity across industries—including staffing. Internal employees and larger on-site temp teams may see new unionization efforts.
